Changes to Eviction procedure…

1 April 2009 saw a change to section 11 of the Homelessness etc (Scotland) Act 2003 which means that landlords must notify the relevant local authority when they raise court proceedings for possession of a dwellinghouse in Scotland. The purpose of the new duty is to give local authorities early notice of households who may be at risk of homelessness due to eviction, enabling them to take appropriate action to prevent homelessness or minimise its impact, where possible.
The reason many landlords employ a reputable agent like Fineholm is that they do not want to have to deal with this type of nitty gritty!
